Turning Two: FoundersCard Pulls Back The Curtain On Its Membership Community For Entrepreneurs

FoundersCardThe top executives in today's largest corporations not only travel in style, but they have access to an absurd array of perks while they travel, from awards and complimentary products to discounts on just about everything. On the IPO "road show" for his company VarsityBooks (now part of eFollet.com), serial entrepreneur Eric Kuhn remembers being "amazed" by witnessing firsthand "the rates and privileges that top executives at the underwriting investment banks received." After leading VarsityBooks to be twice-listed as a public company on NASDAQ (the only company I'm aware of to do so), Kuhn got out in 2006 and started FoundersCard in 2009 -- determined to bring the same rewards and opportunities to entrepreneurs and founders -- "the true risk-takers and value-creators," he says.

SUV hits light-rail train in Sacramento, killing 3 (AP)

SACRAMENTO, Calif. ? An SUV ignored flashing warning lights and veered around a rail crossing arm moments before it collided with a light-rail train, killing two adults and an 18-month-old boy in the vehicle, authorities said.

The only other person in the Nissan Pathfinder, a woman in her 30s, was hospitalized with serious injuries after Saturday's crash, said Niko King, assistant chief with the Sacramento Fire Department.

Six of the roughly 50 passengers on the light rail train suffered minor injuries and were taken to a hospital, he said.

King and a spokeswoman for the transit line said video from a camera at the crossing clearly shows the SUV driving around the crossing arm.

The collision, in a working class neighborhood south of downtown, occurred shortly after 4 p.m. and pushed the Pathfinder about 30 yards from the point of impact.

"All I heard was a big bang, and I saw a light-rail train heading south with a big truck smashed on it," said Ravin Pratab, 42, of Davis, whose car was among those waiting for the train at the rail crossing, on the opposite side of the tracks from the Pathfinder.

The train was going about 55 mph at the time, a typical speed for that location.

The light rail followed two Union Pacific freight trains, which use separate tracks, and the arms had remained down during the interval, said Alane Masui, spokeswoman for the Sacramento Regional Transit District.

"They were down after the UP trains and before the (light rail) train approached, so the crossing arms were properly working," she said.

She said the length of time between the freight trains clearing the intersection and the light rail train crossing it had not yet been determined and would be part of the investigation. Investigators also were reviewing video from a camera mounted on the light rail train.

Authorities did not release the identities of those in the Pathfinder or their relationship. A man and woman in the vehicle, both in their 40s, died at the scene while the toddler was pronounced dead at a hospital. Firefighters said one had been ejected.

The University of California, Davis Medical Center in Sacramento would say only that the woman remained in serious condition late Saturday.

The light rail system carries an average of 50,000 passengers a day, with lines stretching from the state capital to its suburbs in the north, south and east.

Masui said there are four sets of tracks at the crossing ? two for freight and two for light rail so trains from both systems can run in either direction.

Some slam Nazis; others gather for right-wing ball (AP)

VIENNA ? Austrians gathered in memory of the 2 million Jews murdered in Adolf Hitler's Auschwitz camp condemned plans to hold a ball of extreme rightists later in the day Friday, saying the event's timing transformed it into a macabre dance on Holocaust victims' graves.

Ball organizers insisted the fact that their event coincided this year with the 67th anniversary of the death camp's liberation was coincidental and denied suggestions that those attending were extremists.

But opponents vehemently criticized both the day chosen to hold the WKR ball and the political views of those attending it, suggesting it regularly attracts elements from the neo-Nazi fringe. The ball is to be held in Vienna's ornate Hofburg palace, less than a minute's walk away from the memorial event.

The dispute reflects both the distance Austria has come in acknowledging its role in Nazi atrocities and stubborn rightist sentiment among some here, who see themselves as Germans and Germans as the superior race ? a common regional building block of anti-Semitism.

Some of the most bitter comments came from the crowd that converged on Vienna's Heldenplatz, or Heroes' Square, to lay wreaths for the victims of Auschwitz, the concentration camp in occupied Poland where some of Nazis' greatest atrocities were committed during the Holocaust.

"You, who will dance and celebrate here; we remind you of the murder of two-thirds of Europe's Jews," proclaimed Holocaust survivor Rudolf Gelbard. Insisting that Nazi atrocities must never be forgotten, Greens' Party head Eva Glavischnig declared, "It is all the greater perfidy that there will be dancing today on the graves of Auschwitz."

Organizers point out that the ball traditionally takes place on the last Friday in January, but federal government minister Gabrielle Heinisch-Hosek scoffed at their insistence that the timing this year with international Auschwitz commemorations was coincidence.

She called the timing "a big provocation" in comments to The Associated Press, while Greens' Party member Niki Kunrath said the fact "that right-wing extremists can still assemble in the most magnificent halls of the country" was a national shame.

Formally, Austria has moved from a postwar portrayal of being Nazi Germany's first victim to acknowledging that it was Hitler's willing partner. Most young Austrians reject Nazi ideology and condemn the part their parents might have played in the Holocaust.

At the same time, the rightist-populist Freedom Party ? whose supporters range from those disillusioned with the more traditional parties to Islamophobes and Holocaust deniers ? has become Austria's second-strongest political force.

The party, a strong defender of the ball, confirmed Friday that Marine Le Pen, head of France's National Front, planned to attend the event, along with Belgium's Philip Claeys of the Vlaams Belang party and other European far rightists.

The Freedom Party itself went on the offensive, saying the real threat to society came from leftists planning to demonstrate against the ball and warning Austrian Jewish leader Ariel Muzicant that it might press charges of incitement against him for encouraging the protests.

The ball is staged mostly by dueling fraternities including far-right members who display saber scars on their cheeks as badges of honor. But Freedom Party leader Heinz-Christian Strache described the event as "an academic ball, not a political ball."

He accused "extreme-left" opponents of trying to sabotage his party and warned that the protests being organized outside the venue were being organized by anarchists backing "the rule of the street."

But demonstrations that began as the ball guests started to converge on the Hofburg were generally peaceful, with most of the approximately 2,500 demonstrators respecting police lines separating them from the venue.

In the only reported incident, some of the guests were delayed when the two buses carrying them were briefly blocked by sitting protesters who were quickly removed by police.

Although the ball regularly comes under criticism, its overlap this year with the Auschwitz liberation anniversary has increased pressure on organizers and attendees

Because it was listed among other annual champagne-laced Viennese balls, an Austrian committee reporting to UNESCO, the U.N.'s culture organization, struck all the balls from its list of Austria's noteworthy traditions last week.

While some of the more opulent Vienna balls are criticized as a showcase of the rich, most are devoid of direct political controversy. For centuries, the city's high society has waltzed blissfully through wars, recessions and occasional firebomb-throwing anarchists opposed to the moneyed decadence they think such events represent.

But the WKR ball started drawing flack as Austrians began to come to grips decades ago with the fact that their country was one of Nazi Germany's most willing allies instead of its first victim through its 1938 annexation by Hitler.

Bowing to the pressure, the Hofburg palace announced late last year that the ball will have to move elsewhere as of 2013.

Fading Gingrich attacks Romney in ad (Reuters)

MIAMI (Reuters) ? Newt Gingrich struggled to regain momentum in the Republican presidential race on Friday as two new polls showed him falling behind rival Mitt Romney, who was seen as the winner of the final debate before the Florida primary.

The White House contenders courted Florida's sizable Hispanic vote, many of them Cubans, with appearances on Friday at the Hispanic Leadership Network, where Romney received an unusually warm reception and the reaction to Gingrich was more sedate.

Bouncing back after losing the South Carolina primary to Gingrich on Saturday, Romney had an 8-percentage point lead over him in a Reuters/Ipsos poll released on Friday. A Quinnipiac University poll gave him a 9-percentage point edge.

The Reuters/Ipsos online poll gave Romney 41 percent and Gingrich 33 percent ahead of Saturday's contest.

That margin is similar to three polls released on Thursday that all showed Romney taking control of the battle in Florida, where the former Massachusetts governor enjoys a financial and organizational advantage over Gingrich.

Romney battered the former House of Representatives speaker in two debates this week, wounding him in the same format that has helped fuel Gingrich's campaign.

"With the debates now over, Gingrich will need some other way to reverse the tide that appears to be going against him," Quinnipiac University pollster Peter Brown said.

Tuesday's Florida primary is the fourth contest in the state-by-state battle for the Republican nomination to challenge President Barack Obama, a Democrat, in the November 6 U.S. election. Romney won in New Hampshire and former Senator Rick Santorum won the first contest in Iowa.

Romney repeatedly attacked Gingrich at Thursday's debate in Florida, scoring points on immigration, candidates' finances and even lunar exploration.

"That was Romney on Red Bull," Republican strategist Ron Bonjean said. "You could tell Newt was tired, he's carrying a heavy load. He was counting on pure momentum to carry him through Florida, and that momentum has stopped."

At a campaign event in Cape Canaveral, Florida, Romney reminded the crowd of his debate performance.

"How about that debate last night? Wasn't that fun?" Romney asked. "I've had the fun of two debates where I had to stand up and battle, and battling was fun."

'CUBA WILL BE FREE'

An energized Romney, whom Gingrich has described as the most anti-immigrant candidate in the Republican race, won several standing ovations from the Hispanic crowd in Miami earlier on Friday.

"There is a time coming soon when Cuba will be free," Romney told them, adding "America can't sit back" in dealing with the island nation off the coast of Florida.

Gingrich received a much quieter response, once again mocking Romney's call for "self-deportation" of illegal immigrants as "a fantasy. It's not a solution."

Gingrich said the concept might work for younger illegal immigrants who had been in the United States a short time, but not for older immigrants with deep family ties. They should be allowed to apply for citizenship through local councils similar to draft boards, he said.

A Florida win for Romney would put him in a strong position to capture the nomination as the primary map tilts in his favor in February with contests in seven states where he has the potential for strong showings.

Next up on February 4 is Nevada, where Romney won with 51 percent of the vote during his failed 2008 presidential bid. On February 7 Minnesota and Colorado hold caucuses and Missouri holds a primary. Gingrich did not make the ballot in Missouri.

Four of the states with February contests - Nevada, Maine, Colorado and Minnesota - use caucus systems, which often require greater organization to rally voter turnout. That could help Romney take advantage of his superior financial and staff resources.

On February 28, Michigan and Arizona hold primaries. Romney was raised in Michigan, where his father was a governor and car executive.

A new Gingrich television ad in Florida asked: "What kind of man would mislead, distort and deceive just to win an election?"

"This man would be Mitt Romney," the ad's narrator said.

Romney's camp said the sharp tone from Gingrich was a sign he was desperate to distract from his own record as House speaker, where he faced an ethics probe, and as a consultant with mortgage giant Freddie Mac.

"It is laughable to see lectures on honesty coming from a paid influence peddler who suffered an unprecedented ethics reprimand, was forced to pay a $300,000 penalty, and resigned in disgrace at the hands of his own party," Romney spokeswoman Andrea Saul said.

Robert Hegyes, played Epstein on 'Kotter,' dies (AP)

METUCHEN, N.J. ? Robert Hegyes, the actor best known for playing Jewish Puerto Rican student Juan Epstein on the 1970s TV show "Welcome Back Kotter" has died. He was 60.

The Flynn & Son Funeral Home in Fords, N.J., said it was informed of Hegyes' death Thursday by the actor's family.

A spokesman at JFK Medical Center in Edison, N.J., told the Star-Ledger newspaper that Hegyes, of Metuchen, arrived at the hospital Thursday morning in full cardiac arrest and died.

Hegyes was appearing on Broadway in 1975 when he auditioned for "Kotter," a TV series about a teacher who returns to the inner-city New York school of his youth to teach a group of irreverent remedial students nicknamed the "Sweathogs." They included the character Vinnie Barbarino, played by John Travolta.

The show's theme song, performed by John Sebastian, became a pop hit.

Hegyes also appeared on many other TV series, including "Cagney & Lacey."

He was born in Perth Amboy and grew up in Metuchen, the eldest child of a Hungarian father and Italian mother.

He attended Rowan University, formerly Glassboro State College, in southern New Jersey, before heading to New York City after graduation. He returned to Rowan on several occasions to teach master classes in acting, a university spokesman said Thursday.

"He was a good friend to the university," spokesman Joe Cardona said.

Hegyes continued to act after "Kotter" and was a regular on "Cagney & Lacey." He also guest-starred in shows including "Diagnosis Murder" and "The Drew Carey Show."

On his website, Hegyes wrote that he was inspired by Chico Marx, whom he had played in a touring production of a show about the Marx Bros. He also recalled how his mother encouraged him to get involved in theater as a teen.

US Airways 4Q income falls as fuel prices climb (AP)

NEW YORK ? US Airways Group Inc. expects ticket prices and passenger demand will continue their upward climb this year, overshadowing stubbornly higher fuel prices.

It's just the continuation of a "transformation" to a more stable industry where fare sales are less common, tickets are more expensive and rapid addition of flights is rare, says CEO Doug Parker.

Investors applauded the comments Wednesday and brushed off a decline in the company's fourth-quarter earnings. The earnings still topped Wall Street expectations and its stock jumped more than 20 percent in afternoon trading.

The airline also confirmed that it hired advisers to study a possible combination with American Airlines. Though Parker, a long proponent of industry consolidation, said it will likely be some time before any decision is made on a potential tie-up.

American's parent AMR Corp. filed for bankruptcy protection in November. In bankruptcy, AMR could shed billions in debt, reduce its costs and still afford new planes ? a combination that has drawn plenty of attention. Rival carrier Delta and a private equity firm are also reportedly studying a bid.

A big fuel bill lowered US Airways' earnings by 35 percent in the final three months of 2011.

The Tempe, Ariz., company reported net income of $18 million, or 11 cents per share, in the fourth quarter. That compares with $28 million, or 17 cents per share, a year earlier. Excluding charges, it earned 13 cents per share. Analysts surveyed by FactSet had expected earnings of 2 cents per share and typically exclude one-time items from their estimates.

Revenue climbed 9 percent to $3.16 billion. The money the airline made to fly a passenger one mile in the fourth-quarter rose 10 percent to a record 15.2 cents, as it raised fares to offset a $232 million increase in fuel costs. Ticket prices rose much faster than demand did. Traffic in the fourth quarter, which includes the critical holiday season, rose 1.7 percent. US Airways expects passenger demand to remain strong. Analysts had expected revenue of $3.15 billion.

US Airways said demand was strong from both leisure and business travelers.

"We simply do not see any evidence of macroeconomic weakness in our business," President Scott Kirby said in a conference call.

Its shares rose $1.43, or 22.3 percent, to $7.84 in afternoon trading.

For all of 2011, US Airways earned $71 million, or 44 cents per share, sharply lower than the $502 million, or $2.61 per share, it made in 2010. US Airways said if fuel had stayed the same as in 2010, it would have saved $1.2 billion.

Delta Air Lines Inc. said Wednesday its net income soared to $425 million in the fourth-quarter, as it raised ticket prices and reduced flying to keep costs low. Southwest Airlines Co. reported higher net income last week. It overcame a steep run-up in fuel prices by raising fares and flying fuller planes in the fourth quarter.

Both airlines saw gains from their bets on the price of fuel. Airlines can lock in the price of fuel through elaborate contracts, called hedges. They can pay off when fuel prices are climbing, protecting them from huge losses. US Airways doesn't currently hedge against fuel costs.

Charges drag down J&J 4Q profit, but sales rebound (AP)

A slew of charges for recalls, product liability, litigation and an acquisition dragged Johnson & Johnson's fourth-quarter profit down to barely a tenth of what the health care giant made a year ago, and some recalled products won't be back till year's end. But higher sales overseas boosted revenue enough to end an unprecedented two-year decline.

After an embarrassing series of product recalls and other problems overshadowed the past two years, the maker of Tylenol, prescription drugs and medical devices managed to beat Wall Street's forecast for adjusted profit and came in just below its revenue forecast.

The New Brunswick, N.J.-based company said Tuesday that net income was $218 million, or 8 cents per share, down from $1.94 billion, or 70 cents a share, a year earlier.

Excluding charges totaling $2.9 billion, net income was $3.13 billion, or $1.13 per share.

Revenue rose 4 percent to $16.26 billion, up from $15.64 billion in 2010's fourth quarter.

Analysts on average expected earnings per share of $1.09 and revenue of $16.28 billion.

"In the last five years, we've never felt better about our business coming out of one year and going into the next," CEO Bill Weldon told analysts during a conference call.

But he said he doesn't expect significant improvement this year in macroeconomic conditions, with escalating government pricing pressures in the U.S. and Europe and slower growth in the emerging markets that medical product makers are targeting as their best chance for expansion.

Weldon said the slump in elective surgeries, due to unemployed and uninsured people delaying them, continues. That affects sales of J&J's artificial joints and surgical implements and supplies.

"You can only put off procedures for so long," he added.

Revenue fell 3.4 percent in the U.S., to $6.99 billion, but jumped 10.2 percent in foreign countries, to $9.27 billion. The U.S. decline was mostly due to an 8 percent drop in sales of prescription drugs, as two big sellers ? the powerful antibiotic Levaquin and Concerta for attention deficit hyperactivity disorder ? got generic competition late last spring.

Revenue rose 2.7 percent to $6.49 billion for medical devices, and 6.7 percent to $6.09 billion for prescription drugs. Consumer product sales edged up 1.6 percent to $3.67 billion.

Analysts were not impressed.

Erik Gordon, an analyst and professor at the University of Michigan's Ross School of Business, called the results "mediocre," adding that they were "saved, as has become typical for big pharma, by non-U.S. sales."

He said the "slow pace of consumer product sales trying to recover from" more than two dozen recalls of products due to quality problems is disappointing.

Since September 2009, J&J has recalled a host of prescription and nonprescription medicines, as well as replacement hip joints, contact lenses and diabetes test strips. Among the recalls were tens of millions of bottles of children's and adult Tylenol and Motrin, Benadryl, Zyrtec, Rolaids and Simply Sleep pills. The prescription drug recalls have included HIV medicine Prezista and epilepsy pill Topamax.

Reasons for the recalls have ranged from contamination with metal shards and glass particles, to nauseating odors and inaccurate levels of active drug ingredients.

Weldon said in an interview that J&J has eliminated some low-volume products made by its McNeil Consumer Healthcare unit and should have most of the others back by the middle of the year, with the rest returning by year's end.

Analyst Steve Brozak of WBB Securities called the results lackluster. Like Gordon, he's concerned about profit margins declining due to multiple factors, including the costs of factory upgrades and litigation related to product recalls and increasing pricing pressures from government health programs.

Excluding one-time items, J&J's operating margin fell 2 full percentage points for the year, to 24.9 percent, and dropped to 20.3 percent in the fourth quarter. Chief Financial Officer Dominic Caruso said he expects that will almost bounce back in 2012, when he expects earnings of $5.05 to $5.15 per share, excluding special items, and revenue of about $68 billion. Analysts expected earnings of $5.20 per share and revenue of $68.45 billion, according to FactSet.

For the full year, J&J reported net income of $9.67 billion, or $3.49 per share, down from $13.33 billion, or $4.78 per share, in 2010. Revenue rose 5.6 percent to $65.03 billion, from $61.59 billion in 2010.

In afternoon trading, shares of the company rose 2 cents to $65.02.

Josh's Twenty Common Sense Investing Rules | The Reformed Broker

  • Joshua M Brown
  • January 23rd, 2012

I get a lot of inquiries about investment help from people that aren't suitable for what I do or people who simply don't yet meet our minimums.? I hate having to turn folks away, especially loyal readers or people that truly need assistance and can't find anywhere to get it in an unbiased way.

So with that in mind, I'm laying out my Twenty Common Sense Investing Rules.? Please understand that these are not intended to be taken as Iron Law applicable in all situations nor are they meant to be specifically geared toward any one person.? This list of rules is simply my accumulated common sense, learned in victory and defeat (lots of defeat) and it can be applied to a plain vanilla portfolio within one day.

The below is for ordinary investors, not professional traders or those aspiring to become professional traders...

1.? Buy mid-sized and large stocks that are growing earnings and revenue

2. Buy large and mega-sized stocks that are paying consistent dividends and have low debt-to-equity ratios

3. Read the news on your stocks once a week maximum, once a month minimum

4. The moment a stock disappoints you or makes you wish you hadn't bought it, sell it.? Immediately and regardless of price.? Life is too short to hope a bad decision reverses itself

5. Don't get In or Out of the market, but modulate your exposure up and down as a function of what you think is happening.? Your guess based on all the available news and indicators is as good as anyone else's - and it is more important than anyone else's for sure because it is your money on the line

6. You should be willing to take a 20% drawdown on every dollar you have in the stock market.? Obviously being down 20% is not the goal, but it's the reality - it can happen at any time.? It's not a permanent loss but you need to invest as though it could be

7. Don't buy stocks trading over 30 times earnings or under 7 times earnings - something is wrong in both cases.? Stay away from anything not trading on a US exchange.? Avoid the 52-week low list - a loser is a loser

8. Don't buy stocks with market caps under $500 million unless you are playing and can afford to lose 100% of that money

9. Sell any stock with a controversial development or red flag no matter what.? Let someone else be the hero that swoops in on a mispriced, misunderstood security.? You can cheer them on from the safety of the sidelines.? Earnings restatements, auditor resignations, massive unexpected earnings misses, filing delays, fraud allegations etc are all automatic sells.? Let's not act like there aren't 8000 other stocks to choose from in the market

10. Use ETFs to own sectors that are in favor as opposed to individual stocks, when a huge positive trend becomes apparent - you'll get the upside without the single-stock risk.? The aging population and increasing demand for energy are big, fat pitches - it's hard to swing and miss if you own big swathes of these industries via an ETF, make your life easier

11. Avoid all mutual funds except for asset allocators (balanced funds or go-anywhere can be very useful for investors).? Anything based on a discipline (value, growth) or a sector (tech, financial) or a cap size (large, small) is going to underperform its benchmark over the? long-term, mean revert versus its peers and cost you more than you need to spend in internal expenses.? This is fact not opinion

12. Don't try to be a trader unless that's going to be your full-time gig.? Trading as a hobby is not the same as being a trader - and it's less fun than you might think.? If you've decided to become a trader, find a method and stick with it until you can do it regularly

13. Pay no attention to people who are always pessimistic.? The dirty secret is that even when things are terrible, they aren't that bad.? 2008 was the worst sell-off and economic conundrum in 70 years and it only took 18 months for the market? to come all the way back.? If you fell asleep in 2007 and woke up now five years later, your diversified portfolio including dividend? income and unrealized gains/losses looks like nothing ever happened at all

14. Pay no attention to people who are always optimistic.? They are selling something.? if someone can't admit that things suck every once in a while, their cheerfulness has an ulterior motive.? Or they belong in an insane asylum

15. The financial media wants you to think you are missing out on something and that you need to tune in or click to get up to speed.? Pay attention only if you are generally interested and get some entertainment value out of it, most of the time the headlines and segments are dreamed up by editors and producers who need something interesting to talk about each day.? And that's fine, everybody has to earn a living - but don't think anyone is keeping you informed as a public service

16. Don't follow gurus. Don't buy software.? Don't buy DVDs. Don't listen to "Gut Traders". Read books by and about people who've been successful in the market - but only if you're interested. They won't help you become a better investor if you don't care that much to begin with

17. Remind yourself about the difference between investors and traders: Investors make trades when necessary, traders make trades in the course of doing business - that is what they do for a living and your goals are different than theirs.? You don't get paid out on closed positions or a daily p&l statement.

18. Don't trade for excitement even though trading can be exciting at times

19. Don't trade angry or for revenge (this motherf*cking stock owes me!)

20. When you finally do become wealthy, hire other people to do this for you and watch them.? Go about enjoying the short time we all have left on earth away from the screen. Kiss your kids and play tennis and read books and? get drunk during the day just because and go to Australia for a month and buy that car you drove in high school - fix it up and take your sweetheart for a ride. Don't spend that time reading about inverse correlations between German bund yields and the gold/oil ratio.? Because that's all masturbation and really, who gives a sh*t?

Look, the market always goes up given enough time.? It is very hard to find a decade during which returns were negative even though we're just coming off one now.? Stocks go up three out of four years and declines of twenty percent peak-to-trough are extremely rare (declines of 50% are even rarer still and are always a buying opportunity).? So for new or smaller investors the name of the game is to stay in, do smart things while you're in and avoid blowing up.

It's that simple.

2 dead in Ala. as storms pound South, Midwest (AP)

CLAY, Ala. ? Two people were killed in the Birmingham, Ala., area as storms pounded the South and Midwest, prompting tornado warnings in a handful of states early Monday.

At least one of the areas affected by the storms, which were part of a system that stretched from the Great Lakes down to the Gulf of Mexico, was also hit by a line of killer storms that slammed the Southeast last April.

Jefferson County sheriff's spokesman Randy Christian said a 16-year-old boy was killed in Clay and an 82-year-old man died in the community of Oak Grove.

The storm produced a possible tornado that moved across northern Jefferson County around 3:30 a.m., causing damage in Oak Grove, Graysville, Fultondale, Center Point, Clay and Trussville, Christian said. He said several homes were destroyed and numerous injuries were reported.

"Some roads are impassable, there are a number of county roads where you have either debris down, trees down, damage from homes," said Yasamie Richardson, a spokeswoman for the Alabama Emergency Management Agency. Jefferson County experienced "significant damage," she said.

Oak Grove was also hit during last April's tornadoes, but none of homes hit in April were hit again this time, said Allen Kniphfer of Jefferson County's Emergency Management Agency.

As day broke, rescue crews used chainsaws to clear fallen trees off roads in Clay, northeast of Birmingham. Searchers went door-to-door calling out to residents, many of whom were trapped by trees that crisscrossed their driveways.

Stevie Sanders woke up around 3:30 a.m. and realized bad weather was on the way. She, her parents and sister hid in the laundry room of their brick home as the wind howled and trees started cracking outside.

"You could feel the walls shaking and you could hear a loud crash. After that it got quiet, and the tree had fallen through my sister's roof," said Sanders, 26.

The family was OK, and her father, Greg Sanders, spent the next hours raking his roof and pulling away pieces of broken lumber.

"It could have been so much worse," he said. "It's like they say, we were just blessed."

In Clanton, about 50 miles south of Birmingham, rescuers were responding to reports of a trailer turned over with people trapped, City Clerk Debbie Orange said.

Also south of Birmingham, Maplesville town clerk Sheila Haigler said high winds damaged many buildings and knocked down several trees. One tree fell on a storm shelter, but no one was injured, Haigler said. One person was trapped in a heavily damaged home, but was rescued safely. Haigler said police had not been able to search some areas because trees and power lines were blocking roads.

In Arkansas, there were possible tornadoes in Arkansas, Dallas, Lonoke, Prairie and Cleveland counties Sunday night. The storms also brought hail and strong winds as they moved through parts of Arkansas, Tennessee, Illinois and Mississippi.

Tornado warnings were issued for parts of Tennessee, Mississippi and Alabama.

The storm also caused officials to reschedule a planned Monday meeting in Montgomery to receive a study on Alabama's response to a system of storms that raked the state last April. That storm killed more than 240 people in the state. Among the hardest hit areas then was Tuscaloosa, where 50 were killed.

(AP) ? Republican presidential contenders Mitt Romney and Newt Gingrich clashed repeatedly in heated, personal terms Monday night in a crackling campaign debate, the former Massachusetts governor tagging his rival as an "influence peddler" in Washington, only to be accused in turn of spreading falsehoods over many years in politics.

"You've been walking around the state saying things that are untrue," Gingrich said to his rival in a two-hour debate marked by interruptions and finger pointing.

The debate marked the first encounter among the four remaining GOP contenders ? former Pennsylvania Sen. Rick Santorum and Texas Rep. Ron Paul shared the stage ? since Gingrich won the South Carolina primary in an upset last weekend, a double-digit victory that reset the race to pick a rival to challenge President Barack Obama this fall.

Romney was the aggressor from the opening moments Monday night, saying Gingrich had "resigned in disgrace" from Congress after four years as speaker and then had spent the next 15 years "working as an influence peddler" in Washington.

In particular, he referred to the contract Gingrich's consulting firm had with Freddie Mac, a government-backed mortgage giant that he said "did a lot of bad for a lot of people and you were working there."

Romney also said Gingrich had lobbied lawmakers to approve legislation creating a new prescription drug benefit under Medicare.

No. 24 Saint Mary's holds off Santa Clara 93-77 (AP)

SANTA CLARA, Calif. ? Matthew Dellavedova had 26 points and seven assists, Rob Jones added 14 points and 15 rebounds and No. 24 Saint Mary's held off Santa Clara 93-77 on Saturday night.

The Gaels were outhustled and outshot for most of the game and trailed midway through the second half before going on a 15-2 run to pull away for their ninth consecutive win. Saint Mary's (19-2, 9-0 West Coast Conference) is off to its best start under 11th-year coach Randy Bennett.

Jorden Page scored a career-high 19 points and Brad Waldow had 14 points and a career-best 16 rebounds for Saint Mary's, which has won six straight in the series.

Niyi Harrison had 23 points and nine rebounds for Santa Clara (8-10, 0-5). Kevin Foster added 22 but the Broncos couldn't sustain their early momentum and lost their sixth straight.

Saint Mary's won despite going 26 of 45 from the free throw line and 5 for 16 on 3-pointers.

Playing in front of the first sellout crowd at the Leavey Center in nearly two years seemed to give Santa Clara a spark. So did Foster.

The Broncos' junior had eight points in the first 5 minutes and later made his third 3-pointer to put Santa Clara up 29-23 midway through the first half. Santa Clara ran into some foul trouble, which allowed Saint Mary's to make a brief run and take a 44-42 lead before Foster hit another 3.

Robert Garrett then blocked a shot by the Gaels' Tim Williams under the basket. Brandon Clark grabbed the rebound and threw a long pass to Evan Roquemore, who raced down the court for the easy layup to make it 47-44.

Jones, who nearly had a double-double before halftime with 11 points and eight rebounds, then scored on a layup to pull Saint Mary's within one at the break.

Santa Clara opened the second half as well as it ended the first, getting six points from Harrison.

Harrison, knocked out of the game earlier after crashing to the floor going for a rebound, came back and gave the Broncos a 56-52 lead with his second dunk over a 57-second span.

Bennett called a timeout to try to calm his team but it took some time for the Gaels to recover. They missed seven of 11 free throw attempts after the timeout and trailed 64-63 before going on the 15-2 run.

Broncos coach Kerry Keating, frustrated at seeing his team's shot at an upset slip away, was called for a technical foul with 4:47 left and the Gaels up 79-68.

Saint Mary's continued to pull away and went up by 14 following Stephen Holt's driving layup with just over 2 minutes remaining.

Foster, who finished 6 of 16, moved into fourth place on the Broncos career scoring list. He passed Dennis Awtry and Steve Nash, now an NBA star with the Phoenix Suns.

Britain OKs television ads for abortion clinics

LONDON (AP) ? Britain's broadcast advertising body has given the go-ahead for private abortion clinics to advertise their services on television, angering those who say that the move desensitizes the public to the practice.

The Broadcast Committee of Advertising Practice said late Friday there was no justification for barring private clinics that offer post-pregnancy services, including abortions, from advertising on television. Nonprofit post-pregnancy services are already allowed to advertise on television, and their for-profit counterparts are allowed to advertise in all other media.

The organization's spokesman, Matt Wilson, said that "there is not going to be some sort of free-for-all saying: 'Come to us to get an abortion.' They are not there to promote abortion, they have to promote an array of services."

Speaking to Britain's right-leaning Daily Mail, Conservative lawmaker Nadine Dories said the move would allow broadcasters to make a profit "through advertising revenue off the back of a service which ends life. It's appalling."

British law allows abortion up to the 24th week of pregnancy, so long as two doctors agree that the procedure would cause less harm to a woman's physical or mental health than carrying the fetus to term. There is no time limit in cases which pose a serious risk to the life of the mother.

This undated image obtained by The Associated Press shows the homepage of the website Megaupload.com. Federal prosecutors in Virginia have shut down one of the world's largest file-sharing sites, Megaupload.com, and charged its founder and others with violating piracy laws. (AP Photo)

WELLINGTON, New Zealand (AP) ? With 150 million registered users, about 50 million hits daily and endorsements from music superstars, Megaupload.com was among the world's biggest file-sharing sites. Big enough, according to a U.S. indictment, that it earned founder Kim Dotcom $42 million last year alone.

The movie industry howled that the site was making money off pirated material. Though the company is based in Hong Kong and Dotcom was living in New Zealand, some of the alleged pirated content was hosted on leased servers in Virginia, and that was enough for U.S. prosecutors to act.

The site was shut down Thursday, and Dotcom and three Megaupload employees were arrested in New Zealand on U.S. accusations that they facilitated millions of illegal downloads of films, music and other content, costing copyright holders at least $500 million in lost revenue.

New Zealand Police also seized guns, artwork, more than $8 million in cash and luxury cars valued at nearly $5 million after serving 10 search warrants at several businesses and homes around the city of Auckland.

News of the shutdown seemed to bring retaliation from hackers who claimed credit for attacking the Justice Department's website. Federal officials confirmed it was down for hours Thursday evening and that the disruption was being "treated as a malicious act."

A loose affiliation of hackers known as "Anonymous" claimed credit for the attack. Also hacked was the site for the Motion Picture Association of America.

On Friday, New Zealand's Fairfax Media reported that the four defendants stood together in an Auckland courtroom in the first step of extradition proceedings that could last a year or more.

Dotcom's lawyer raised objections to a media request to take photographs and video, but then Dotcom spoke out from the dock, saying he didn't mind photos or video "because we have nothing to hide." The judge granted the media access, and ruled that the four would remain in custody until a second hearing Monday.

Dotcom, Megaupload's former CEO and current chief innovation officer, is a resident of Hong Kong and New Zealand and a dual citizen of Finland and Germany who had his name legally changed. The 37-year-old was previously known as Kim Schmitz and Kim Tim Jim Vestor.

Two other German citizens and one Dutch citizen also were arrested and three other defendants ? another German, a Slovakian and an Estonian ? remain at large.

The Electronic Frontier Foundation, which defends free speech and digital rights online, said in a statement that the arrests set "a terrifying precedent. If the United States can seize a Dutch citizen in New Zealand over a copyright claim, what is next?"

The indictment was unsealed one day after websites including Wikipedia and Craigslist shut down in protest of two congressional proposals intended to make it easier for authorities to go after sites with pirated material, especially those with overseas headquarters and servers.

Before Megaupload was taken down, the company posted a statement saying allegations that it facilitated massive breaches of copyright laws were "grotesquely overblown."

"The fact is that the vast majority of Mega's Internet traffic is legitimate, and we are here to stay. If the content industry would like to take advantage of our popularity, we are happy to enter into a dialogue. We have some good ideas. Please get in touch," the statement said.

Several sister sites were also shut down, including one dedicated to sharing pornography files.

The $8 million in cash seized had been invested in various New Zealand financial institutions, and has been placed in a trust pending the outcome of the cases.

Police spokesman Grant Ogilvie said the seized cars include a Rolls Royce Phantom Drophead Coupe worth more than $400,000. Two short-barreled shotguns and a number of valuable artworks were also confiscated, he added.

According to the indictment, Megaupload was estimated at one point to be the 13th most frequently visited website on the Internet. Current estimates by companies that monitor Web traffic place it in the top 100.

Megaupload is considered a "cyberlocker," in which users can upload and transfer files that are too large to send by email. Such sites can have perfectly legitimate uses. But the Motion Picture Association of America, which has campaigned for a crackdown on piracy, estimated that the vast majority of content being shared on Megaupload was in violation of copyright laws.

The website allowed users to download some content for free, but made money by charging subscriptions to people who wanted access to faster download speeds or extra content. The website also sold advertising.

Megaupload was unique not only because of its massive size and the volume of downloaded content, but also because it had high-profile support from celebrities, musicians and other content producers who are most often the victims of copyright infringement and piracy. Before the website was taken down, it contained endorsements from Kim Kardashian, Alicia Keys and Kanye West, among others.

The company listed Swizz Beatz, a musician who married Keys in 2010, as its CEO. He was not named in the indictment and declined to comment through a representative.

The five-count indictment, which alleges copyright infringement as well as conspiracy to commit money laundering and racketeering, described a site designed specifically to reward users who uploaded pirated content for sharing, and turned a blind eye to requests from copyright holders to remove copyright-protected files.

For instance, users received cash bonuses if they uploaded content popular enough to generate massive numbers of downloads, according to the indictment. Such content was almost always copyright protected, the indictment said.

The Justice Department said it was illegal for anyone to download pirated content, but their investigation focused on the leaders of the company, not end users who may have downloaded a few movies for personal viewing.

A lawyer who represented the company in a lawsuit last year declined to comment Thursday. Efforts to reach an attorney representing Dotcom were unsuccessful.

Although Megaupload is based in Hong Kong, the size of its operation in the southern Chinese city was unclear. The administrative contact listed in its domain registration, Bonnie Lam, did not respond immediately for a request for comment sent to a fax number and email address listed.

The indictment was returned in the Eastern District of Virginia, which claimed jurisdiction in part because some of the alleged pirated materials were hosted on leased servers in Ashburn, Virginia. Prosecutors there have pursued multiple piracy investigations.

The Justice Department also was investigating the "significant increase in activity" that disrupted its website. It said in a statement that it was working to "investigate the origins of this activity, which is being treated as a malicious act until we can fully identify the root cause."

The site appeared to be working again late Thursday. A spokesman for the Motion Picture Association of America said in an emailed statement that the group's site also had been hacked, but it too appeared to be working later in the evening.

"The motion picture and television industry has always been a strong supporter of free speech," the spokesman said. "We strongly condemn any attempts to silence any groups or individuals."
